The U.S. Supreme Court has determined that peer grading does not violate FERPA because grades on students' papers are not education records covered by the Act, "at least until the teacher has recorded them." Owasso Independent School District No. 1-1011 v. Falvo, No. 00-1073 (U.S. 2002).
